My Home Delivery Consumer Terms of Service
Last Updated: September 29, 2026
Welcome to My Home Delivery! These Terms and Conditions (“Terms”) govern your access to and use of My Home Delivery App Inc.’s (“Company,” “we,” “our,” or “us”) website, mobile application, customer portals, and related platform services (collectively, the “Services”). By accessing or using our Services, booking a delivery, or accepting an SMS delivery tracking link, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.
1. Overview & Platform Operating Model
My Home Delivery App Inc. operates a logistics technology platform and marketplace that connects commercial merchants, retailers, and end consumers (“Customer,” “you,” or “your”) with independent motor carriers (“Carriers”) and FMCSA-licensed property broker partners (“Designated Broker”).
- Technology Licensor Status: My Home Delivery App Inc. is a software technology provider—not a motor carrier or freight broker. It does not own, operate, or maintain delivery vehicles or employ delivery drivers.
- Brokerage & Transportation Services: All freight brokerage, load tenders, rate confirmations, and settlement reconciliations arranged via the Services are facilitated exclusively by the Designated Broker pursuant to 49 C.F.R. § 371. Physical transport and white-glove delivery services are performed exclusively by independent Carriers.
2. Eligibility & Account Responsibilities
To access or use the Services, you represent and warrant that:
- You are at least 18 years of age or the legal age of majority in your jurisdiction.
- You possess the legal authority to enter into a binding contract and bind any entity on whose behalf you are booking.
- All registration, delivery address, contact details, and site access information provided by you are accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Booking, Upfront Pricing & Payments
- Locked-In Quotes: All delivery pricing is provided prior to booking confirmation. Once confirmed, quotes are locked—subject to the accuracy of the site conditions, item descriptions, and delivery specifications provided by you.
- Payment Processing: Payments are processed securely via third-party payment gateways. You authorize the Company (or its payment processor) to charge your selected payment method for all fees incurred, including applicable taxes, storage fees, or wait-time surcharges.
- Cancellations & Rescheduling:
- No Cancellations: All payments for all orders are final and non-refundable.
- Pre-Dispatch Modification: Modifications and/or schedule changes made at least 24 hours prior to the scheduled delivery window may be eligible for a partial refund equal to 70% of the original payment amount.
- Post-Dispatch Modifications: Modifications made after a Carrier has been dispatched, or failure to grant entry during the scheduled window, will result in a non-refundable Attempt Fee equal to 100% of the base delivery rate.
- Surcharges & Access Fees: Unreported stairs (beyond two flights), narrow doorways requiring item disassembly, long carries (>100 feet from vehicle to entryway), or delays exceeding 15 minutes past the arrival window will incur additional automatic surcharges charged to your payment method.
4. Consumer Site Preparation & Entry Warranties
You are strictly responsible for preparing your residence or commercial property prior to the Carrier’s arrival. By booking a delivery, you explicitly represent and warrant that:
- Site Readiness & Pathway Clearance: All driveways, walkways, hallways, stairwells, entryways, doors, and room locations are completely clear of ice, snow, mud, debris, personal property, and obstacles.
- Dimensional Verification: You have measured all entry points, doorways, hallways, elevators, and stairwells to ensure the ordered item(s) can safely pass through without causing structural damage or requiring excessive force.
- Pet & Child Containment: All domestic pets and minor children must be safely secured in a separate room for the entire duration of the delivery team’s presence on your property.
- Pre-Existing Property Damage Disclosure: You must document and disclose any pre-existing property damage (e.g., scratched floors, cracked drywall, loose handrails) to the delivery crew upon their arrival prior to entry.
- Structural Safety & Building Access: You are responsible for reserving loading docks, freight elevators, or securing municipal parking permits if required by your building, HOA, or municipality. The Carrier reserves the right to decline entry if site conditions are deemed unsafe, hazardous, or physically impossible.
5. In-Home Delivery, Installation & Plumbing Disclaimers
- White-Glove Delivery Scope: Standard delivery includes transport of the item to the room of choice, unboxing, and packaging debris removal only. Unless explicitly purchased as an additional add-on, the following are excluded from the delivery scope:
- Assembly: includes assembly of physical furniture components using basic tools. (e.g., joining sections of modular couch, building bed frame)
- Haul Away: includes removal of furniture or mattresses, equipment or other approved items.
- Appliance Hookups: If basic appliance connection (e.g., washing machine hoses, refrigerator water lines) is included in your service:
- You warrant that all existing shut-off valves, water lines, gas valves, and electrical outlets are fully functional, compliant with local code, and located within 4 feet of the appliance.
- Neither the Company nor the Carrier shall be liable for water leaks, flooding, or property damage resulting from pre-existing corrosion, faulty customer shut-off valves, brittle pipes, or improper home infrastructure.
- Delivery crews are strictly prohibited from attempting connections to rusted, corroded, or non-standard valves.
- Utility, Electrical & Plumbing Disclaimers: Carriers do not perform hardwired electrical work, structural gas line modifications, or main plumbing altercations.
6. Electronic Proof of Delivery (ePOD) & Acceptance
- Digital Sign-Off: Upon completion of the delivery, you (or your designated adult representative over age 18) must inspect the delivered item(s) and property. You will be required to execute digital Electronic Proof of Delivery (“ePOD”) sign-off on the Carrier’s mobile device or via an automated SMS confirmation link.
- Conclusive Evidence: Execution of the ePOD, or failure to note missing items/visible damage on the ePOD at the time of delivery, constitutes conclusive prima facie evidence that:
- The item(s) were received in undamaged, pristine condition; and
- The delivery, placement, and installation services were fully performed without damage to your real or personal property.
- Photographic Record: You grant the Carrier explicit permission to take timestamped, geotagged photographs of the delivered item(s), placement location, and surrounding entry pathways for quality assurance, safety, and claim verification purposes.
7. Strict Property Damage & Cargo Claim Protocol
If you allege that a Carrier caused physical damage to your residence, real property, or personal belongings during delivery, you must strictly comply with the following claims procedure:
- Strict 48-Hour Reporting Window: All property damage and cargo claims must be reported in writing to claims@myhomedelivery.com within forty-eight (48) hours of the completion of the delivery window. Failure to submit a complete claim within 48 hours constitutes an absolute waiver of your right to file a claim or recover damages from the Company, the Designated Broker, or the Carrier.
- Mandatory Claim Evidence: Your claim submission must include:
- (1) Detailed written description of the alleged damage;
- (2) High-resolution photographs showing specific damage, close-ups, and wide-angle contextual shots of the room/entryway;
- (3) A copy of the ePOD document or delivery receipt; and
- (4) Independent repair estimates or original purchase receipts.
- Right of Physical Inspection: Prior to any claim repair, payout, or settlement, you must allow the Company, the Carrier, or their insurance adjusters physical access to the property to inspect the alleged damage within seven (7) business days of reporting. Altering, repairing, or painting over alleged damage prior to inspection will result in the immediate denial of the claim.
8. Prohibited Items & Transport Restrictions

- Hazardous, flammable, explosive, corrosive, or radioactive materials;
- Firearms, ammunition, or controlled substances;
- Currency, precious metals, high-value jewelry, or unrated fine art;
